More and more building owners are realizing that energy efficiency retrofits, demand management, and on-site production solutions make sense from both an environmental and business perspective. As clean tech entrepreneurs are developing business solutions to meet this demand, a number of critical business issues must be explored:
- Should my company guarantee performance? If so, how?
- What are the key contractual issues that will need to be negotiated with customers?
- What financing approaches can be used for energy efficiency and on-site production projects?
- How can public incentives be maximized to improve a project's pro forma?
- How can these projects tie to broader public and private initiatives such as the Smart Grid?
This session will provide practical advice for the clean energy entrepreneur on these critical business issues through a panel that has extensive experience on a wide variety of energy efficiency, demand management, and renewable energy projects. The session will include a presentation from the panelists and a Q&A session. Please stay after the panel discussion for a cocktail reception at the offices of Holland & Knight.

David D. Streicker is a Senior Counsel in the Chicago office of Holland & Knight and practices in the areas of energy project finance, land use, and public policy. Mr. Streicker represents a variety of public and private sector clients regarding energy and energy efficiency related matters with an emphasis on public private partnerships, project siting, tax and other economic incentives, as well as environmental permitting matters. Mr. Streicker's recent projects include:
- Representing project developers regarding various project finance, siting, permitting, and associated legislative activities involving the development of utility scale renewable energy and clean coal projects.
- Representing entities in the renewable energy and energy efficiency areas looking to commercialize and market new technologies.
- Representing energy developers and building owners negotiate power purchase and interconnection agreements.
Mr. Streicker is a member of Holland & Knight's Energy, Environment, and Sustainability teams. He is a frequent speaker on energy related topics and has recently authored a chapter on public incentives and market drives for the green technology industry which can be found at by clicking here.

Jonathan E. Furr is a Partner in the Chicago office of Holland & Knight and practices in the areas of energy efficiency, state and local government contracting, and public policy and advocacy. Mr. Furr represents a variety of public and private sector clients on energy performance contracting projects that guarantee significant reductions in energy consumption in existing buildings. Mr. Furr's recent projects include:
- Representing the owner of the Empire State Building on a high profile energy efficiency project for this landmark structure. The project resulted in a replicable contract template that can be used by other property owners for energy retrofits, building on the standard contract form Mr. Furr prepared for the Building Owners & Management Association (BOMA) International Energy Performance Contracting Model program.
- Representing the Public Building Commission of Chicago on its procurement of energy performance contracting services for the Richard J. Daley Center.
- Representing the Village of Northbrook, Illinois in the structuring of its green building initiative, which includes a variety of incentives and requirements relating to LEED Green Building Rating Systems and construction recycling.
Mr. Furr serves as a co-leader of his firm's national Sustainable Development Team, and was a co-editor of a recent American Bar Association publication on legal issues related to green building and sustainable development.

Mike Munson Michael Munson is CEO of Metropolitan Energy, a company focused on integrating large commercial building operations into regional energy market prices and operations. In this role, Mr. Munson has focused his career on developing competitive energy markets from both the supply and demand side of the meter. In this role, Mr. Munson has:
- Initiated the construction of a utility-scale virtual generator with the Building Owners and Managers Association of Chicago (BOMA/Chicago). This project will install smart grid technology in more than 260 BOMA/Chicago member buildings in the City of Chicago’s central business district. At scale, the project can reduce regional prices, while providing operating reserves and, for the first time, frequency regulation from demand side resources.
- Assisted in creating the Illinois retail electricity market and its rules by advocating for efficient markets, transparency and information access.
- Assisted various buildings in receiving the first energy savings available from electric deregulation in Illinois in 1999, and the first demand response revenues from the PJM economic real-time program after integration into the Regional Transmission Organization in 2005.
Additionally, since the inception of electric open-access, Mr. Munson has owned and operated his own law firm, practicing primarily in the energy policy and litigation. On behalf of BOMA/Chicago, Mr. Munson served as lead counsel in dozens of legal proceedings and other venues addressing the transition to electric competition. He received his B.A. in Government and Politics from the University of Maryland in College Park, Md. In 1988, and earned a joint JD/MBA from Willamette University in Salem, Ore. in 1994.
